Terms of Service

These Terms govern your use of Inbox OSS services. By creating an account or using our services, you agree to these Terms.

Acceptance

By signing up for or using Inbox OSS, you confirm that you have read these Terms, accept them, and have authority to bind your organization. If you do not agree, do not use the service.

Account responsibilities

You are responsible for keeping your credentials secure, for the actions of your team members, and for the content you send. You must keep your account contact information accurate.

Acceptable use

Use of the service is subject to our Acceptable Use Policy and Anti-Spam Policy. Violations may result in immediate suspension.

Service levels

Enterprise customers receive a 99.99% uptime SLA with service credits as described in their order form. All other plans are provided on a commercially reasonable basis.

Fees and payment

You agree to pay fees described on the pricing page or in your order form. Overage charges apply at your plan rate unless you have set a hard cap. We may change fees with 60 days notice.

Term and termination

Either party may terminate for material breach with 30 days written notice and an opportunity to cure. We may suspend immediately for violations of the AUP or for non-payment after 15 days.

Intellectual property

You retain all rights to content you send through the service. We retain all rights to our platform. You grant us a non-exclusive license to process your content solely to provide the service.

Confidentiality

Each party agrees to protect the other party’s confidential information with the same care it uses for its own, no less than reasonable.

Warranties and disclaimers

We provide the service on an "as is" basis. We disclaim all warranties not expressly granted, including merchantability, fitness for purpose, and non-infringement.

Limitation of liability

Our aggregate liability for any claim is limited to the amount you paid in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or punitive damages.

Indemnification

You agree to indemnify us for any claim arising from your content or your violation of these Terms. We agree to indemnify you for any claim that the service infringes a third party’s intellectual property.

Governing law

These Terms are governed by the laws of Delaware. Disputes are resolved in the state and federal courts in Wilmington, Delaware.

Changes

We will notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
